12 - Expiry

12.1    If, in respect of a particular Contract Account, there has been:

12.1.1    No action logged by either party on the online portal; and

12.1.2    No written communication received by us from either party to the Contract,

for a period of six months, we will thereafter send to each party once per quarter a notice seeking instructions as to their intentions for any Retention still held within the Scheme (a “Dormancy Notice”)

12.2    If we do not receive any response from either party to any Dormancy Notices for a period of six years (counted from the date on which activity was last logged on the online portal by one of the parties, or from the last receipt by us of written communications from either party, whichever is later), then:

12.2.1    The Contract will be automatically discharged from the Scheme; and

12.2.2    We will be entitled to distribute any cash held within the relevant Contract Account to any charity of our choosing that is Registered with the Charities Commission in England and Wales (provided that the said cash is not at the time held on trust for any party other than the two parties in receipt of the Dormancy Notices).

12.3    We will incur no liability to the parties for distributing the balance of any Contract Account in compliance with this Rule 12.
